SHORT-TERM RENTAL AGREEMENT FOR A HOUSE

Entered in Montreal
BETWEEN:

Vincent Bolduc, residing in Montreal, hereinafter referred to as the "Lessor",
AND:
the "Tenant".

PURPOSE OF THE AGREEMENT

The Landlord rents to the Tenant, for a fixed term, the house located at 933 Route Prévost, St-Pierre, IO, Quebec, registered as a tourist accommodation establishment under CITQ number [----].

1. Description of the accommodation

Type: Detached house, fully furnished.
Features: 4 bedrooms, 2 bathrooms, equipped kitchen, Wi-Fi access, terrace, games room, parking.
Maximum capacity: 6 people. ( 6 adults and 3 kids)
Condition: The accommodation is provided in good condition, clean and functional, with all necessary amenities.

2. Arrival and Departure

Arrival: From 4:00 PM
Departure: Before 11:00 AM
The minimum rental period is 2 days and the maximum is 30.

3. Rent Amount and Payment Terms

Total rent includes:
Rental Fees
Lodging Tax (3.5%)
GST/QST (14.95%)

Payment Terms:
50% deposit payable upon signing the contract by credit card or bank transfer.
Balance due no later than 45 days prior to arrival.
Security deposit of CAD 500, refundable within 5 days of departure, subject to inspection of the property.

4. Cancellation Policy

By the Tenant:
Cancellation more than 45 days prior to arrival: full refund of the deposit.
Cancellation between 45 and 14 days prior to arrival: 20% refund of the total rental fee, 100% of the cleaning fee.
Cancellation less than 14 days prior to arrival: no refund.
By the Landlord: Full refund of all amounts paid.

5. Tenant's Obligations

Respect the maximum capacity of 9 people.
Do not smoke inside the accommodation.
Do not organize noisy parties or events.
Maintain the accommodation in good condition and report any damage immediately.
Comply with municipal regulations.
Vacate the premises at the agreed time and leave the accommodation clean.

6. Landlord's Obligations

Provide accommodation that is clean, safe, and consistent with the description.
Provide the promised amenities (e.g., Wi-Fi, bedding).
Conduct a post-departure inspection and refund the security deposit within the agreed timeframe, except in the event of damage.

7. Specific Rules

Pets: Prohibited.
Parking: 5 spaces available.
Quiet Hours: Respect quiet hours from 11:00 p.m. to 7:00 a.m.

8. Insurance

The Landlord declares that they have $2,000,000 in civil liability insurance covering tourist accommodations.
The Tenant is responsible for purchasing travel or personal insurance to cover their personal belongings and any incidents during their stay.

9. Dispute Resolution

Any dispute relating to this contract will be submitted to the competent courts of Quebec, in accordance with the Civil Code of Quebec.

Short-Term Rental Terms and Conditions

ANNEX TO THE SHORT-TERM RENTAL AGREEMENT

House located at 933 Route-Prévost, St-Pierre I.O., Quebec

These terms and conditions govern the use of the house rented short-term by the Tenant from the Landlord. By signing the rental agreement, the Tenant agrees to abide by these conditions.

1. Use of the House

Occupation: The house is rented for temporary residential use only, with a maximum capacity of 9 people (6 adults and 3 kids). Any subletting or assignment of the contract is strictly prohibited without the Landlord's written consent.
Prohibited Activities: Parties, noisy events, or any commercial activity (e.g., film shoots, professional photo shoots) are prohibited without prior written authorization. Respect for Neighbors: The Tenant must respect the quiet hours from 11:00 p.m. to 7:00 a.m. and avoid any behavior that could cause a nuisance to neighbors.

2. Specific Property Rules

Smoking: Smoking is strictly prohibited inside the property. A cleaning fee of CAD 200 will be charged in addition to the normal cleaning fee for non-compliance.
Pets: Pets are prohibited.
Amenities: Use of the amenities is subject to the instructions provided in the Welcome Guide. Any inappropriate use resulting in damage will be charged to the Tenant.
Parking: 5 parking spaces are available. Unauthorized vehicles will be towed at the Tenant's expense.

3. Maintenance and Housekeeping

Tenant Responsibility: The Tenant agrees to maintain the property in good condition, to report any damage or malfunction immediately, and to leave the premises in a reasonably clean condition at the end of the stay. Cleaning Fee: A cleaning fee of CAD 200 is not included in the rent. An additional fee will be charged if the property is left in a condition requiring exceptional cleaning (e.g., stains, excessive waste).
Garbage: The Tenant must place garbage in the designated containers according to the municipal collection schedule.

4. Security Deposit

A security deposit of CAD 500 is required.
The deposit will be refunded within 5 days of departure, after inspection of the property, less the costs for:
Damages caused by the Tenant or their guests.
Additional cleaning fees.
Breaking rules (e.g., smoking, parties).
In the event of damage exceeding the deposit, the Tenant agrees to cover the additional costs.

5. Safety and Responsibilities

Safety: The Tenant must comply with safety instructions (e.g., smoke detectors, fire extinguishers, emergency exits).
Liability: The Tenant is responsible for any damage caused by themselves, their guests, or their pets. The Landlord is not responsible for any injuries, loss, or damage to the Tenant's personal belongings.
Insurance: The Landlord holds $2,000,000 in liability insurance for tourist accommodations. The Tenant is encouraged to purchase personal travel insurance.

6. Taxes and Fees

Lodging Tax: A tax of 3.5% of the rent or CAD 3.50 per night is included and will be remitted to Revenu Québec.
GST/QST: If applicable, GST (5%) and QST (9.975%) are charged in addition to the rental cost.
The Tenant is informed that the Landlord declares all rental income to the tax authorities.

7. Arrival and Departure

Arrival: The Tenant may access the accommodation starting at 4:00 p.m. Access instructions (e.g., key box, code) will be provided prior to arrival.
Departure: The Tenant must vacate the accommodation no later than 11:00 a.m. Late checkout will incur a fee of CAD 50 per hour.

8. Municipal By-laws and CITQ

The Landlord guarantees that the accommodation complies with municipal by-laws and is registered with the Corporation de l'industrie touristique du Québec (CITQ) under number [].
The Tenant agrees to comply with municipal by-laws regarding noise, parking, and waste management.

9. Dispute Resolution

Any dispute will be submitted to the competent courts of Quebec, in accordance with the Civil Code of Quebec.
The parties agree to attempt an amicable resolution before initiating legal proceedings.
